Prices and Goods and Services Tax (GST)

Unless otherwise stated, all prices quoted are inclusive of GST.

Your customer details

You must accurately provide all requested details. These include, but are not limited to, date of birth, contact details and all pre-existing medical conditions. For more information about how we treat your personal information please refer to our Privacy Policy.

Refusal of guest

We reserve the right to refuse service to guests who have failed to give us proper or correct notice of any disability, illness, pregnancy or other condition requiring special care, attention or treatment or who, in our sole opinion, are physically or mentally unfit for the tour.

We reserve the right to require you to leave a tour for the safety and enjoyment of yourself and other guests. Reasons may include, but are not limited to;

  • being under the influence of alcohol or other drugs, including prescription medication, that may affect performance
  • being unable or unwilling to follow instructions
  • having inadequate physical ability or experience for the activity
  • being ill or injured
  • behaving in a manner which is reckless and endangers themselves and/or others
  • having a condition that could have an impact on safety that cannot be appropriately managed
  • being fatigued to a level that, in our opinion, endangers themselves or others.

In such an event, you are not entitled to any compensation from us.

Travel insurance

We recommend you take out your own travel insurance policy covering service cancellations, the inability to travel or continue with the service, loss of or damage to personal effects, medical, evacuation and repatriation expenses and accidental death or disability.

Change of Itinerary

You appreciate and acknowledge that the itinerary may change due to factors outside of our control, at times with short notice. This may be due to operational requirements, staff availability, weather conditions, mechanical problems or government restrictions. We will notify you as soon as possible if changes are needing to be made and offer you a full refund if we are unable to adapt the program to give you an expereince of equivalent value and nature.

Acceptance of risk

You acknowledge that the nature of the tour may be adventurous, and participation involves a degree of inherent risks and dangers that may cause serious injury and possible death to participants.

You fully understand that there are risks and dangers associated with your participation in “the activities” and accept these risks entirely

To the fullest extent permitted by law, and except to the extent that this disclaimer may be prohibited by Australian Consumer law or other applicable legislation, you agree to release us, our contractors, employees and agents, and any licensor or licensee from all claims and actions that you have, or may have at any time in the future, against them or any of them, howsoever arising, for personal injury, death, property damage or any other loss, damage or expense that you may suffer as a result of your participation in any trip organised with, or in conjunction with Navigate Expeditions.

Smoking

We have a non-smoking policy on all our tours for the safety end enjoyment of our staff, other guests and the bushfire hazards it presents, it is also a requirement for all the sites we operate in.

Publicity

Navigate Expeditions may publicise its involvement in the provision of the services including, but not limited to; social media publications and print, and internet and video advertisements. Unless such information remains commercially sensitive, such publication may include the names of the guest and the nature of the services. The guest approves Navigate Expeditions using the guest’s name, photographs of the guest, and other intellectual property for such purposes.

Age and fitness requirements

Guests under the age of 18 must be accompanied by a legal guardian or responsible person over the age of 18.

There is no maximum age limit for our tours. However, please check the physical requirements of a tour to determine your suitability.

Tour Information

Navigate Expeditions provides itineraries and tour details. It is your responsibility to ensure you have read and understood these documents, and to ensure you are properly prepared for the locations and experiences expected.

Updating terms and conditions

Navigate Expeditions reserves the right to update and/or alter these terms and conditions at any time, and it is your responsibility to be familiar with them. The latest terms and conditions can always be found on our website and will supersede any previous versions.

Waiver

I am 18 years of age or older, and I have read and understand these “terms and conditions”. I understand that constitutes a release of liability and an indemnity for all claims. If I am the parent and/or guardian of the participant I have read and understand and execute “Terms and conditions’ on behalf of the child/ward.

E-newsletter subscription

By confirming a booking at Navigate Expeditions you agree to receive emails from us including subscribing to our e-newsletters. The frequency of the e-newsletter issues will be at most 4 per year. We will not communicate / spread / publish or otherwise give away your address, please visit our privacy policy for more information. You’ll be able to change your subscription settings or to delete it altogether at anytime.

COVID

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus which may have direct or indirect consequences, including but not limited to, medical issues, border closures and/ or quarantine requirements. We will take all reasonable steps to ensure your safety and may require you to follow additional mandatory safety protocols on your trip including the completion of medical checks, signing of waivers, completion of medical assessments or evidence of extra precautions.

Any travel restrictions, quarantine, isolation costs incurred as a result of participating on a Navigate Expeditions tour will be at your own cost and we will not be liable.

It is your responsibility to stay up to date with current government travel warnings and travel restrictions.

If you are cancelling a tour due to government mandated travel restrictions, the tour will be fully transferable to another person or another time. Government mandated travel restrictions include the following:

  • Border closures at time of tour departure
  • Lockdown orders for yourself or location of the tour at time of tour departure
  • Travel cancellations preventing you from arriving on the tour.

We will investigate each situation on a case-by-case basis to determine if you are unable to travel due to the above factors.

If you have ‘flu-like symptoms’ supported by a medical certification, you will be able to transfer the tour.

We reserve the right to ask for any reasonable evidence, written statements and or documents to support the reasons for cancellations.

Day Tours

Payment

Full payment is required at time of booking

Cancellation by you

The Traveller may cancel the services at any time, however, if the Traveller cancels the services:

More than 48 hours prior to the commencement of the services, Navigate Expeditions may retain 10% of the amount paid as an administration fee.

Less than 48 hrs prior to the commencement of the service or if the guest does not appear for the service, Navigate Expeditions may retain 100% of the total amount paid.

Cancellation by us

Navigate Expeditions may cancel the Service for any reason and at any time before the commencement of the Services, including if the number of Travellers participating in the Services does not meet the minimum number of guests required by Navigate Expeditions, or if third party providers cancel all or part of the Services. In this event, Navigate Expeditions will provide a full refund of all monies paid.

In the event that there is a state or national lockdown as a result of the COVID-19 pandemic which results in the Services being cancelled or the guests not being able to travel to participate in the Services, Navigate Expeditions will offer a credit to the Traveller for use within twelve (12) months of the date of the cancellation.

Cancellation due to Force Majeure: includes but is not limited to: ‘acts of God’, war; civil commotion, riot; blockade or embargo, fire, explosion, breakdown, union dispute, earthquake, epidemic, pandemic or other health emergency, faults or errors in navigation or management of this or of any other Vessel, seizure of the Vessel under legal process, any abrupt or unexpected increase in the cost of fuel or shortage of fuel, flood, windstorm or other extreme weather event, lack or failure of courses of supply, passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

If a tour is cancelled due to a Force Majeure Event, we will refund you all monies paid minus any of our unrecoverable costs.

Mountain Bike Waiver, Release of Liability and Hire Agreement

You must agree to the following terms and conditions to hire our equipment: 

  • You agree to Navigate Expeditions charging your credit card for all costs associated with repair of our equipment that is damaged beyond general wear and tear and/or for the recovery/ replacement of equipment that isn’t returned by the hirer in a timely manner
  • The hirer is liable for all debt recovery costs born by Navigate Expeditions associated with the recovery or repair of our equipment that you hire, including the administrative and legal costs of recovery, any debt overdue by 28 days or more will be reported to debt reporting agencies
  • You agree to pay a late fee of $66 per item, per hour or part thereof for all equipment returned later than the agreed time
  • In order to avoid costs associated with late fees or replacement you must ensure the security of our equipment throughout your hire timeframe
  • Navigate Expeditions reserve the right to refuse service to guests who have failed to give us complete or correct notice of any disability, illness, pregnancy or other conditions that may require special care, attention or treatment or who, in our opinion, are physically or mentally unfit to safely conduct our tour.
  • You must accurately provide all requested details. These include, but are not limited to, date of birth, contact details and relevant pre-existing medical conditions.
  • You appreciate and acknowledge that the itinerary may change due to factors outside of our control, at times with short notice.
  • We have a non-smoking policy on all our tours for the safety and enjoyment of our staff, other guests and the bushfire hazards it presents, it is also a requirement of our NSW National Parks Pass and other sites we operate on. 
  • You acknowledge that the nature of the tour may be adventurous, and participation involves a degree of inherent risks and dangers that may cause serious injury to participants.
  • You understand and accept that wearing a helmet while cycling is a requirement by law in NSW Australia.

To the fullest extent permitted by law, and except to the extent that this disclaimer may be prohibited by Australian Consumer law or other applicable legislation, you agree to release us, our contractors, employees and agents, and any licensor or licensee from all claims and actions that you have, or may have at any time in the future, against them or any of them, howsoever arising, for personal injury, death, property damage or any other loss, damage or expense that you may suffer as a result of your participation in any trip organised with, or in conjunction with Navigate Expeditions.

Multi-day tours

Payment

Payment: You are required to pay a non-refundable deposit of 10% per person, per tour for your booking to be confirmed. If your booking is made within 42 days of the departure date, then the full amount is payable at the time of booking. Once you have made a payment this will indicate your acceptance of our booking terms and conditions.

Final payment is due 42 days before the departure. If this final payment is not paid on or before the due date, we reserve the right to treat your booking as cancelled.

Cancellation by you

If you cancel some of all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip: 

(a) 56 days or more prior to departure, we will hold your deposit amount as a credit 

(b) between 56 days and 28 days, we charge a cancellation fee of 20% of the total booking cost

(c) between 28 and 14 days prior to departure, we charge a cancellation fee of 60% of the total booking cost 

(d) 14 days of fewer prior to departure, we charge a cancellation fee of 100% of the booking cost.

Cancellation by us

Except when your tour is cancelled due to a Force Majeure Event (defined below) if we cancel your tour, you have the choice of a 100% credit or refund of all monies paid to us.

Cancellation due to Force Majeure: includes but is not limited to: ‘acts of God’; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; faults or errors in navigation or management of this or of any other Vessel; seizure of the Vessel under legal process; any abrupt or unexpected increase in the cost of fuel or shortage of fuel; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

If a tour is cancelled due to a Force Majeure Event, we will refund you all monies paid minus any of our unrecoverable costs.

Accommodation arrangements

Navigate Tourism does not require single guests to pay a surcharge for travelling alone on the majority of our trips. Our tours are primarily on a twin share basis, so if you are joining the group as a solo guest, we will match you with another guest. However, if you prefer not to share a room, we also offer single supplements that will guarantee a single room.
